OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. This Contest is intended solely for U.S. residents and shall be governed solely by U.S. law. Do not enter Contest website if you are not located in the United States at the time of entry.
Eligibility: Contest is open only to legal residents of the 50 United States and District of Columbia, who are 21 years of age or older. This Promotion is void where prohibited. Employees, officers, and directors (and their respective immediate family members (spouse, parents, siblings, children) or household members (whether or not related)) of Champion® Target (“Sponsor”), subsidiaries, affiliated companies, distributors, dealers, and wholesalers, and their respective advertising and promotion agencies are ineligible. By participating, entrant agrees to these Official Rules and the decisions of the Sponsor and/or its independent judges, which are final and binding in all respects.
Contest Description: Champion® Range Contest (“Contest”) is a skill Contest in which entrants 21 years of age or older submit an essay testimonial (200 words or less) describing why you are the perfect candidate to receive a Private Shooting Range for the real property you own or use.
To Enter: You may enter beginning at 9:00:01 AM Eastern Time ("ET") 07/01/11 through 11:59:59 PM ET 12/31/11 ("Contest Period") by going to the website www.championbackyard.com. Click on the Contest icon, banner or text link to access the Contest Registration page, and completely and accurately follow the directions to enter the Contest. You must enter and submit your full name, address, city, state, zip code, daytime phone number, and e-mail address. Each entrant must complete the entire Official Entry Form accurately; including submission of an original essay testimonial using 200 words or less describing why you are the perfect candidate to receive a Champion® Private Shooting Range for the real property you own or use (the "Essay"). Limit of one entry per person/e-mail address. Entries must be received and recorded by Sponsor's computer (the official Contest time keeping device) by 11:59:59 PM ET on 12/31/11. For details on how your information may be used, see our terms of use/privacy policy at http://glarp.atk.com/policies/PrivacyPolicy.html. All robotic, programmed, script, macro or other automated entries, or third party entries will be disqualified. Any attempt to enter the Contest more than one time by using multiple/different e-mail addresses, identities, or any other prohibited methods will void that entrant from participating in the Contest.
All entry information submitted becomes the property of Sponsor and will not be returned. Once an Essay is submitted; it cannot be changed, altered, or modified. All entries become the property of Sponsor and will not be returned. Correspondence and inquiries concerning the Contest will not be accepted, acknowledged, or returned. Essays must be the original and sole creation of the entrant, and all rights, title and interest in the essay must be owned solely by the entrant and may not have been submitted in any other competition; may not have been published; and must not infringe upon any third party’s rights, including but not limited to, copyright, patent or trademarks/trade names/logos, or rights of privacy or publicity. Each entrant warrants and represents that his or her essay complies with all of the preceding conditions. Entries may not be submitted on entrants’ behalf by third-parties. Any entry, in the sole opinion of the judges and/or Sponsor, found to contain dangerous, harmful or objectionable content, or deemed to be inappropriate for publication, will be disqualified. Any additional materials submitted to Sponsor (such as photos, artwork, samples, etc.) will not be included in the judging process, nor will they affect, in any way, the outcome of the Contest. Winners will be selected based solely on the Essay criteria. In the event of a dispute, all entries will be deemed to have been submitted by the holder of the e-mail account submitted in connection with entering the Contest. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the Internet access provider, on-line service provider or other organization responsible for the assigning of e-mail addresses for the domain associated with such e-mail account. No forms of entry other than as stated in the Official Rules will be accepted.
Judging: Beginning January 3, 2012, Champion Range Contest finalists will be selected from the pool of eligible entries received from qualified entrants by Sponsor and/or independent judges, whose decisions are final and binding on all judging matters related to this Contest. Judging will be based on the following criteria: 1) Content of Testimonial as it relates to the Essay Topic (50 points), 2) Creativity of Essay (25 points) and 3) Proper Use of Language (25 points) (the "Essay criteria"). The eligible entries with the top 10 highest point totals will be deemed Finalists. Finalists will be anonymously reviewed by independent Finalist judge, Tom Knapp; one of today's greatest exhibition shooters and holder of 3 world records. Identity of Finalist judge is subject to change depending on availability. The Finalist judge will evaluate the Finalist entries using the Essay criteria. The three entrants whose Finalist entries receiving the three highest combined cumulative scores from the Finalist judge will be declared the potential Grand Prize, First Place Prize and Second Place Prize Winners, respectively. In the event of a tie, the entrant whose essay has the highest score for the Content of Testimonial of Essay criterion shall win the tiebreaker. The Prize Winners will be announced on or about March 14, 2012 and the Sponsor will attempt to notify the potential Prize Winners by overnight mail delivery.
Claiming Prize/Release: As a condition of winning and qualifying for the prize, the Prize Winners will be required to complete an Affidavit of Eligibility, a Liability Release and a Publicity Release where lawful within 14 days of receipt of prize notification. If the documents are not returned in a timely manner, or if any prize notification or any prize is returned as undeliverable, or if a Prize Winner is found to be ineligible or declines the prize or otherwise is not in compliance with these Official Rules, prize may be forfeited, and the prize will be awarded to an alternate winner from the remaining pool of Finalist entries with the highest score from the Finalist judge. If documents are not returned in a timely manner, or if prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize will be forfeited and an alternate winner selected. Winner may not transfer, assign, or substitute prize.
Prize Details/Odds of Winning: One (1) Grand Prize: The entrant with the highest Finalist judge score will be awarded the Ultimate Shooting Range Package with an approximate retail value (ARV) of $1,786.00. Grand Prize Package will consist of: EasyBird® Auto-Feed – Doubles Trap, Remote Releases – Doubles, Trap Taxi™, Trap Cover, Sporting Clays Variety Pack, Leather Trapshooting Pouch, EasyHit Shotgun Sights, Ballistic Shooting Glasses, Electronic Muffs and Gel Plugs, Triple Varmit Radiation Green, Target Packer, All Target Stand, VisiColor™ 8" Bull Paper Target, VisiColor™ Deer, VisiColor™ Prairie Dog, VisiColor™ Coyote and VisiShot Sight In. One (1) First Place Prize: The entrant with the second highest Finalist judge score will be awarded a First Place Champion Prize Package consisting of the following prizes: Wheelybird Trap, Trap Cover, Easy Hit Shotgun Sights, Ballistic Shooting Glasses, Passive Slim Muffs, Gel Plugs, .22 NRA Auto Reset Target, VisiChalk Multi-Color Refill Pack, VisiChalk Target Wheel, Target Packer, All Target Stand, VisiColor 8" Bull Paper Target, VisiColor Deer and a VisiShot Sight In. ARV of First Place Prize Package is $761.00. One (1) Second Place Prize:The entrant with the third highest Finalist judge score will be awarded a Second Place Champion Prize Package consisting of the following: SkyBird 3/4 Cock Trap with Foot Release, Triple Varmint Radiation Green, DuraSeal Triple Bottle and Cans, Double DuraSeal Spinner, Clay Hand Thrower, Ballistic Shooting Glasses, Passive Slim Muffs, Gel Plugs, .22 Target Tree, VisiChalk Multi-Color Refill Pack, VisiChalk Target Wheel, Target Packer, All Target Stand, VisiColor 8" Bull Paper Target and a VisiShot Sight In. ARV of the Second Place Prize Package is $550.00. Prizes cannot be substituted for cash. Sponsor reserves the right to substitute prize of greater or equal value in event prize or portion of prize is unavailable for any reason. All taxes on prizes, if any, are solely the responsibility of the winner. Prize excludes, and winner is solely responsible for all costs and expenses. Winners are responsible for real property site preparation and compliance with all applicable State, County, City, or Township codes, rules, regulations, statutes or other restrictions and zoning reviews. Winner must own or have the right to access and use (for purposes of the prize) adequate real property acreage sufficient to accommodate the Winner's prize, as determined by the State, County, City, or Township regulations/ordinances. Winner must designate to Sponsor the land on which the prize will be used within 30 days of prize notification. Winner is solely responsible for compliance with State, County, City, or Township zoning regulations/ordinances concerning the discharge of firearms. Sponsor not responsible for loss, delay or damage in shipping. Odds of winning depend on the total number of eligible entries received during the entry period. LIMIT ONE PRIZE PER HOUSEHOLD.
General Terms and Conditions: By entering, participants agree (a) that Sponsor, its parent, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, (individually and collectively "Releasees") are indemnified, released and will be held harmless by participants from any and all liability, for any damages, injuries or losses of any kind (whether due to negligence or otherwise) to person(s), including death, or property, violation of intellectual property or personal rights (such as but not limited to, copyright, patent, trademark/trade name, and/or rights of privacy or publicity or portrayal in a false light), or violation of any codes, rules, regulations or statutes due to whole or in part to acceptance, possession, misuse or use of any prize; arising directly or indirectly from his/her participation in this Contest or any Contest-related activity; and (b) except where prohibited by law, winner grants (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor's authority the right to the use his/her name, photograph, likeness, voice, image, statements and biographical information at any time or times, in perpetuity, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web and Internet, without review, notification, approval or additional compensation. In addition, Winners shall permit Sponsor, and those acting pursuant to its authority, to reproduce Winner's Essay or any portions thereof, which may be altered, changed, modified, edited, used alone, together or with other works, and/or in distorted form, as solely determined by Sponsor. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to delivery or use of the prize awarded. By entering, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules. Participants agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will participants be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental, and consequential damage, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Limitations of Liability: Releasees are not responsible for lost, late, stolen, illegible, destroyed, incomplete, inaccurate, misdirected, or non-delivered entries; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or computer virus or other damage caused to entrant's computer by accessing Contest website, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any equipment or programming associated with or utilized in this Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web site. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Contest or Web site, to be acting in violation of the terms of the Web site or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Releasees are not responsible for injury or damage to participants' or any other person's computer related to or resulting from participating in this Promotion or downloading or copying materials from or use of Web site. If, for any reason, the Contest is not capable of running as planned, Sponsor reserves the right, at its sole discretion, to suspend the Contest, notification of which will be provided on Web Site at www.championbackyard.com, and select the winners from eligible entries received prior to suspension, or as otherwise deemed fair and equitable by Sponsor. All properly claimed prizes will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules. Unclaimed prizes will not be awarded. Any attempt to deliberately damage any web site or undermine the legitimate operation of the Contest is unlawful and subject to legal action by Sponsor or its agents.
IN NO EVENT WILL RELEASEES BE RESONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OF NON-INFRINGEMENT.
